Trump Abandons Travel Ban Legal Fight, Vows to Issue a New Executive Order on Immigration

Protesters of Trump travel ban at airportAfter a Washington federal district court granted a temporary restraining order halting the enforcement of the travel ban, Trump and the Department of Justice quickly appealed the decision to the Ninth Circuit Court of Appeals. The Ninth Circuit sits below the U.S. Supreme Court. The Ninth Circuit reviewed the issue and agreed with the Washington District Court, continuing to uphold the “ban on the ban” (the judicial ban on the enforcement of the travel ban).

Characteristically, during the course of these legal decisions, Trump continually ridiculed these adverse decisions and the judges who issued them. His lack of respect for the separation of powers and other branches of our government, like much of his campaign and presidency, is without precedent.

Trump Plans to Release a Revised Executive Order in Immigration in the Coming Weeks

While Trump and the Department of Justice could either request that the full Ninth Circuit evaluate the decision (initially, a three-judge panel decides a case) or appeal to the U.S. Supreme Court, Trump has decided to hold off on further appeals, and instead craft a new executive order that will not suffer from the same legal and constitutional issues that resulted in the demise of his first order.
