Non-immigrant visa holders who are lawfully present but have either an expired visa or changed their status in the United States must receive a new visa before re-entering the United States after international travel. For various reasons, many would rather not return to their home country and want to receive a new visa in a third country. This tech tip will answer many of the questions these people may have.
What is the general rule?
According to the Department of State, non-immigrants are generally encouraged to apply for the visa in their home country because the third country has much discretion in refusing to issue the visa. However, subject to the limitations below, a third country national can at least attempt to receive their visa in the third country.
Who is eligible to apply for a visa in a third country?
Generally, anyone who maintained lawful status in the United States and who is lawfully present in the third country may apply for the visa.
However, holders or applicants of E visas are typically always denied issuance of an E-visa.
Each consulate may also have specific requirements of eligibility and applicants should review the consulate page of the country in which they wish to apply.
